AHMEDABAD: The Gujarat high court issued a notice to Anand district police after a farmer sought police protection for himself and his younger son from his elder son over a property dispute.
The petition was filed by one Babubhai Parmar, 66, who wants protection for himself and his younger son Hitesh from his elder son Manish Parmar, who was objecting to his bid to reconstruct a damaged house in their field, which is their ancestral property.
The petitioner’s advocate, Vivek Bhamare, submitted that Babubhai and Hitesh were trying to reconstruct a house on their ancestral land in Vadod village after receiving a court order in their favour following a property dispute.
But Manish and other family members objected to it and a quarrel resulted in fisticuffs. Babubhai fractured his thumb and his son Hitesh also suffered injuries. They had to dial emergency numbers to ensure they were escorted out of the place safely. After undergoing treatment, they filed an FIR at Vasad police station.
Babubhai requested the cops to provide him and Hitesh police protection from Manish and other family members, but the district superintendent of police rejected his request saying it was a civil dispute. So, he approached the high court.
During the hearing, Justice Samir Dave remarked that even if it is a civil dispute, a person cannot be allowed to assault anybody. The court has sought reply from the police and Manish and scheduled further hearing for later this month.
