Gurgaon: Congress MLA Mamman Khan, who was arrested in connection with the July 31 violence, was granted bail by a Nuh court in two cases on Saturday. Khan, who has been named in four cases linked to the riots, however, will remain in jail till he gets bail in the remaining cases.
Khan’s counsel Tahir Hussain said the additional sessions judge Sandeep Kumar Duggal granted bail in the cases related to FIR numbers 149 and 150. In the bail application, moved on Tuesday, the MLA, through his counsel, had pleaded that the other co-accused in cases linked to the riots have been granted bail, so similar relief should be extended to him.
“Khan was not named in the FIR, his name was added in the cases by police on the basis of the disclosure statements of those who were named in the FIR. There is no direct evidence against Khan to prove his involvement in the violence,” Hussain said. “We are hopeful of getting bail in the other two cases (related to FIR numbers 137 and 148) as well.”
The case will be heard next on October 3.
Manish Shandilya, the prosecution’s counsel, said they opposed the bail application on the ground that the Firozpur Jhirka MLA was an influential person and could influence the witnesses and tamper with evidence. He added that police investigation indicated Khan was the mastermind of the violence. “Police recovered two mobile phones from Khan and both had been formatted. The phone has been sent for forensic examination and the report is awaited,” Shandilya said.
Khan was arrested from Jaipur on September 15 after his name was retrospectively added to FIRs for allegedly inciting mob attacks on worshippers while the Brijmandal Jalabhishek Yatra was crossing Nuh. Hours before his arrest, Nuh police had told the Punjab and Haryana high court they had “evidence” that showed the MLA was in touch with members of the mob.
Of the four cases registered at the Nagina police station in Nuh against the MLA, one is related to a mob attack at an intersection in the district and another is linked to alleged looting and burning down of an oil mill owned by a BJP functionary.
The Congress’s Haryana unit had alleged that its MLA was arrested due to a ‘political witch-hunt’ and demanded a judicial probe into the Nuh violence under the supervision of a high court judge.
